The Changing Face of Temporary Intent

Presentation Description: Since 2021, USCIS and DOS guidance has been updated on one of the most challenging concepts in immigration law - temporary intent. This session will explore the guidance (and the reality) of counseling students and exchange visitors on travel, and on permanent residence options for O-1s and TNs. We will consider the 2022 Biden STEM Initiatives, and how the J-1 Early Career STEM Initiative and expanded use of National Interest Waivers interacts with the concept of intent. Our panelists will offer a variety of perspectives and suggestions on advising in the new era of temporary intent.

  • Evaluate institutional policy in light of the Biden 2022 STEM Immigration Initiatives.
